Labor Law Office, A.P.C is currently investigating the following types of claims:

  • Trucking company cases: Many truck drivers are not paid for performing inspection of trucks.
  • Owner-operator trucking cases: Trucking companies "sell" trucks to drivers but treat the driver like they are employees.
  • Contractor's misclassification cases: Employees are misclassified as "independent contractors" so they employer can escape paying overtime.
  • Meal period cases: Employees are not provided meal periods. In some cases, a half hour of pay is deducted from pay for meals that were not taken.
  • Reimbursement cases: Employees incur expenses for their employer and are not reimbursed.
  • Uniform cases: Employees are required to purchase uniforms.
  • Overtime cases: Employees are not paid time and a half for overtime worked.
  • Manager misclassification cases: Employees are treated as "managers" and not paid overtime.
  • Salesperson cases: For example, Route Sales drivers are not properly paid. Employers treat them as salespersons paid by commission, rather than as truck drivers paid by the hour.
